1. General provisions

   1. The online shop available at www.bathroom-rea.ie is operated by Podlasiak Andrzej Cylwik sp.k.
   2. These Terms apply to consumers and business users (with exceptions outlined in section 9).
   3. The Seller is the data controller; processing principles are set out in the Privacy Policy available in the shop.
   4. Definitions: Business Day, Order Form, Client/Customer, Account, Newsletter, Product, Terms and Conditions, Online Shop, Seller, Sales Contract, Electronic Service, Service User, Order.
   5. Entrepreneur with consumer rights – certain consumer protections also apply to a natural person concluding a contract directly related to their business activity, where the content of the contract shows it is not of a professional nature for that person (as provided by law).

2. Electronic services

   1. Account – created by filling in a registration form and accepting the Terms; free of charge, for an indefinite period; deletion upon request (e-mail/post).
   2. Order Form – an interactive cart; a one-off service ending upon submission of the order or interruption of the process.
   3. Newsletter – optional; unsubscribe anytime by e-mail.
   4. Technical requirements – internet-connected device, e-mail, current browser, cookies and JavaScript enabled, minimum screen resolution 1024×768.
   5. Prohibited content – illegal or abusive content is forbidden; users must provide accurate data.
   6. Complaints regarding services – e-mail: office@bathroom-rea.ie; reply within 14 days.

3. Conditions for concluding the sales contract

   1. The contract is concluded once the Customer places an order via the Order Form and the Shop confirms it by e-mail.
   2. Prices are given in EUR inclusive of VAT; delivery costs and any additional charges are shown during the ordering process.
   3. The content of the contract is recorded through these Terms and the confirmation e-mail.
   4. The final ordering button is clearly labelled to indicate an obligation to pay (e.g. “Order and pay”).

4. Payments

   1. Accepted payment methods: card payment, Apple Pay, Google Pay, PayPal, bank transfer.

   3. Payment deadline: card/online/transfer – within 7 days of contract conclusion; cash on delivery (where available) – upon handover.

5. Delivery and collection

   1. Delivery is chargeable unless otherwise stated. Details and rates appear in the checkout.
   2. Delivery methods: Dachser, DPD, GLS (depending on size/weight of the parcel).
   3. Delivery time: typically 5–10 working days after dispatch (to Ireland).
   4. Standard delivery is to the building entrance/ground floor; indoor delivery or carrying upstairs is not included unless arranged separately (surcharge may apply).

6. Complaints (non-conformity of goods)

   1. The Seller must deliver goods in conformity with the contract. Consumer rights arise under applicable EU and Irish consumer law.
   2. The complaint procedure also applies accordingly to an entrepreneur with consumer rights where provided by law.
   3. Submission: office@bathroom-rea.ie; please describe the non-conformity, date of discovery, and your request (repair/replacement; price reduction/withdrawal – if legally justified).
   4. Response within 14 days; absence of reply within the deadline means the complaint is deemed accepted.
   5. Where return inspection is necessary, the Seller provides instructions and communicates the return address individually (depending on the logistics centre).

7. Out-of-court dispute resolution (ADR)

   1. Consumers may contact a competent ADR body in Ireland; we recommend first attempting an amicable settlement with the Seller.
   2. Participation in ADR is voluntary unless otherwise required by mandatory legislation. Note: the EU ODR platform was discontinued on 20.07.2025.

8. Right of withdrawal

   1. The statutory withdrawal period is 14 days; the Shop grants an extended period of 60 days for distance contracts without giving reasons (from the moment of taking possession of the goods).
   2. Submitting the statement: by e-mail to office@bathroom-rea.ie.
   3. Refund: within 14 days of receiving the withdrawal statement; the Seller may withhold the refund until receiving the goods or proof of dispatch.
   4. The return address is not published in advance – it is provided individually after contacting support (in accordance with the appropriate logistics centre).
   5. Direct return costs are borne by the consumer.
   6. The consumer is liable for any decrease in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
   7. Exceptions apply in accordance with law (e.g. customised goods, sealed hygiene items after opening, digital content not supplied on tangible medium with prior consent, etc.).
   8. The 60-day rule also applies by analogy to an entrepreneur with consumer rights to the extent permitted by law.

9. Provisions for entrepreneurs

   1. The Seller may restrict available payment methods (e.g. require prepayment).
   2. Risk of accidental loss/damage passes to the entrepreneur once the parcel is handed over to the carrier.
   3. The entrepreneur must check the parcel upon delivery and, in case of visible damage, immediately request a damage protocol with the carrier.
   4. Liability is limited to typical and foreseeable losses up to the order value; loss of profit is excluded.
   5. These limitations do not apply where mandatory rules grant protections to the entrepreneur with consumer rights.

10. Privacy policy

    1. Scope of data

       1. Identification and contact data (name, address, e-mail, phone), delivery/billing data, order/payment history, technical data (IP, device identifiers, cookies) and correspondence content.
       2. Providing data is voluntary but necessary for contract performance or specific services.

    2. Purposes and legal bases

       1. Order handling and after-sales service – Art. 6(1)(b) GDPR.
       2. Account management, queries and complaints – Art. 6(1)(b) and (f) GDPR.
       3. Accounting/tax obligations and archiving – Art. 6(1)(c) GDPR.
       4. Own marketing (newsletter with consent) – Art. 6(1)(a) and (f) GDPR.
       5. Analytics, statistics and service security – Art. 6(1)(f) GDPR.

    3. Recipients of data

       1. Transport/logistics (Dachser, DPD, GLS), payment providers (e.g. PayPal), hosting/IT, accounting, customer support – only as necessary.
       2. Data is not sold to third parties.

    4. Transfers outside the EEA

       1. As a rule, data is not transferred outside the EEA; if exceptionally required, appropriate safeguards such as Standard Contractual Clauses are applied.

    5. Retention periods

       1. Contract data – for the duration of performance and legal retention periods.
       2. Marketing data – until consent is withdrawn or an effective objection is raised.
       3. Technical/cookie data – according to cookie lifespan and browser settings.

    6. Rights of data subjects

       1. Right of access, rectification, erasure, restriction, portability, objection; right to withdraw consent (without affecting past lawful processing).
       2. Right to lodge a complaint with the competent authority.

    7. Cookies and similar technologies

       1. The website uses necessary cookies and – with your consent – functional, analytical and marketing cookies.
       2. Cookie settings can be managed via the browser or a consent panel; this may affect feature availability.

    8. Profiling

       1. We may conduct basic profiling (e.g. for newsletter segmentation) without legal effects; lawful basis is legitimate interest or consent.

    9. Security

       1. We apply appropriate technical and organisational measures including TLS encryption, access control, backups and data minimisation.

    10. GDPR contact

        1. Contact: office@bathroom-rea.ie. If a Data Protection Officer is appointed, their details will be published on the website.

11. Final provisions

    1. Contract language: English (Ireland).
    2. Changes to the Terms may occur for justified reasons (legal changes, payments, delivery methods); users of continuous services will be informed at least 14 days in advance; objection entitles to termination.
    3. For matters not covered herein, Irish law and applicable EU consumer and e-commerce legislation apply.
    4. After purchase, the Shop may send an optional request to review the shopping experience.
